1. SCOPE / GENERAL

Shop@ReNovium is the online market of ReNovium. The offer of Shop@ReNovium is limited to the territories of Switzerland and the Principality of Liechtenstein. Depending on the place of delivery, the offered assortment may differ. These General Terms and Conditions (hereinafter referred to as GTC) apply to all services provided by Shop@ReNovium. Shop@ReNovium may amend the GTC at any time. Such changes come into force immediately with their publication.

2 REGISTRATION and ORDERING GOODS

2.1 Registration

Registration with the online store is reserved exclusively for persons of legal capacity. It is free of charge. There is no entitlement to admission to the Online Shop. The data necessary for the registration are to be indicated by the customer completely and truthfully. The customer is responsible for updating his data.

2.2 Placing of orders / Conclusion of contract

Orders are placed exclusively online via the Internet order page. Delivery dates for deliveries by Shop@ReNovium's personal delivery service can be reserved in advance. The customer's orders will be confirmed by e-mail. A contract between the customer and ReNovium is only concluded with this confirmation of the order. ReNovium is free not to accept an order - for whatever reason - and to refuse its confirmation. With his order, the customer confirms the correctness of all information provided by him.

2.3 Quantity limitations

In any case, Shop@ReNovium reserves the right to limit the delivery quantity of certain products or, if necessary, not to deliver a certain product at all.

2.4 Changes and cancellation of orders

Subsequent changes to already confirmed orders are not possible. Cancellation of confirmed orders is possible up to 36 hours before delivery.

2.5 Incomplete fulfillment of the order

To deliver all ordered products in sufficient quantity and high quality is the top priority of Shop@ReNovium. Nevertheless, in exceptional cases it may happen that for various reasons not enough goods are available or cannot be released for delivery. If products are not available at the time of delivery, they will be forwarded. The actual quantity delivered will be indicated on the definitive delivery bill and on the invoice. The customer is not entitled to real or compensation in case of shortened or undelivered quantities. If an article is not delivered despite billing, the customer will be credited the corresponding amount in value or the article will be forwarded.

3. DELIVERY

3.1 Delivery of goods

Goods are delivered directly to the delivery address and contact person provided by the customer. Depending on the assortment and place of delivery, delivery is made by Shop@ReNovium's personal delivery service or by various services of the Swiss Post. The delivery is made to the private individuals or to the reception / reception in case of corporate customers, if accessible.

3.2 Delivery times and compliance with delivery deadlines

Shop@ReNovium and Swiss Post shall make every effort to meet delivery deadlines. However, all delivery times announced by Shop@ReNovium are for guidance only. Failure to comply with the delivery times does not give the customer the right to withdraw from the contract or claim damages. In the event that Shop@ReNovium or its delivery partners are unable to deliver an order confirmed by Shop@ReNovium, Shop@ReNovium shall not be obligated to deliver the goods elsewhere. This does not entitle the customer to any compensation.

3.3 Delivery fees

The amount of the delivery fee depends on the delivery method, order value and order frequency. Depending on the assortment and delivery method, a minimum order value may apply. 

3.4 Delivery bill and invoice

Delivery bills and invoices are sent electronically whenever possible.

3.5 Deposit of deliveries

For quality and safety reasons, Shop@ReNovium endeavors to personally hand over the delivery of goods to the customer. If a personal handover is not possible during the agreed delivery time, the goods will be deposited at the front door. However, if the customer / client wishes to pay for the delivery on the spot, he / she is obliged to be present at the agreed delivery date. If a personal delivery and simultaneous payment is not possible, the goods will be taken back. Shop@ReNovium reserves the right in such cases to charge a flat-rate handling fee of CHF 50. With the delivery of the goods, respectively the deposit of the goods in front of the door, benefit and risk, especially the risk of theft, damages by third parties and environmental influences are transferred to the customer. Deliveries by Swiss Post to addresses without home delivery will be deposited at the place where Swiss Post deposits parcels for such addresses.

3.6 Cancellation of delivery by Shop@ReNovium

If the successful delivery is not possible or only possible under difficult circumstances for reasons for which ReNovium is not responsible, e.g. wrong delivery address, absence of the recipient, lack of access permit, bad weather or traffic conditions, etc., ReNovium is entitled to cancel the order. Any claim of the customer for damages or real compensation is in this case fully excluded.

4. prices and payment

Assortment and prices are basically in accordance with ReNovium's offer.

4.1 Price conditions

All prices are in Swiss Francs, excluding applicable value added tax. The prices as they are displayed on the internet page at www.renovium.ch at the time of the order are decisive.

4.2 Payment methods / Credit assessment

For payment, depending on the assortment and shipping method, various payment methods are available, whereby ReNovium is entitled in each case to decide at its own discretion which means of payment it will accept in each specific individual case. Shop@ReNovium is expressly authorized by the customer to carry out credit checks at its own discretion and, if necessary, to pass on the customer's data to third parties for this purpose. If a customer is at the time of the order with the settlement of previous invoice amounts in arrears or the personal credit limit has been exceeded, the payment method " invoice" is not available. Invoices are sent in each case after delivery, if possible electronically, otherwise by mail to the master address specified by the customer or enclosed directly with the delivery of goods. Invoices are to be paid within 20 days without deductions and other discounts. Unauthorized deductions will be charged subsequently. If payment is not made on time, a charge of CHF 20 plus interest on arrears of 5% per annum will be levied. In case of late payment by the customer, ReNovium Genossenschaft is entitled to commission third parties with the collection of outstanding payments as well as to assign the claims to third parties in Switzerland and abroad. This is associated with costs for the customer. Which payment methods can be selected will be displayed for selection in each case during the order process.

5. GUARANTEE OF DATA COMMUNICATION

Data communication via the Internet cannot be guaranteed to be error-free and/or available at all times according to the current state of the art. Shop@ReNovium is therefore not liable for the constant and uninterrupted availability of the online store, nor for technical and electronic errors during a sales transaction, in particular for the delayed processing or acceptance of orders.

6. RIGHT OF RETURN AND REFUND POLICY 

A right of return exists only in case of wrong delivery or manufacturing defects. Defects must be reported within 10 days, replacement deliveries are free of shipping costs. A right of return is excluded for digital media (CD-ROM, online databases, e-books, e-teaching materials, apps, etc.). 

6.1 RIGHT OF RETURN AND REFUND POLICY FOR DIGITAL MEDIA

For certain digitally published titles, distribution is only possible within Switzerland or the Principality of Liechtenstein.

ReNovium GmbH reserves the right to discontinue the availability of a digitally published title at any time. If a title becomes unavailable between the time of purchase on the website and activation, the customer has the right to a refund of the purchase price for that title if a claim is made in writing to Renovium GmbH within a period of 30 days. If the applications support an offline mode, already downloaded or installed data will remain available on the customer's personal device even after the distribution of the digitally published titles has been terminated.

A refund of the purchase price is excluded in any case, even if the applications and their memory are deleted by the customer or can no longer be used as a result of software updates or version changes (namely for the operating system).

Renovium GmbH cannot guarantee that server- and/or client-based applications are executable on all devices. Printing or copying of texts is not possible in all cases.

7. GENERAL CONDITIONS

7.1 Data protection

The collected data will be treated confidentially and in good faith. On the occasion of the first contact, your data will be collected in the form of personal information such as surname, first name, address, age, email for business processing as well as for marketing purposes. In addition to the explicitly entered data, various information is automatically collected from the log files (a kind of "work report" of the computer) when accessing the website. Shop@ReNovium distinguishes between master data (e.g. IP address, date and time of access, etc.) and movement data (e.g. name of the file accessed, click path, etc.). For statistical purposes, such data is analyzed anonymously, for example to determine how many times the portal is accessed on a given day. Shop@ReNovium uses Tealeaf as well as Google Analytics, a web analytics service provided by Google Inc. Google Analytics uses so-called 'cookies' to evaluate the use of the website and compile reports on website activity. State-of-the-art security technology is used to protect your data against unauthorized processing. In principle, no liability can be assumed for the security of data transmitted via the Internet. The transmission of data is not encrypted. However, we offer automatic encryption for sensitive data.

7.2 Severability clause

Should any part of these terms and conditions prove to be unenforceable or invalid for any reason, this shall not affect the validity of the remaining provisions.

7.3 Applicable law & place of jurisdiction

Swiss law is exclusively applicable. The place of jurisdiction for natural persons is Bern or at the domicile of the customer. For legal entities, the exclusive place of jurisdiction shall be Bern.
